Small stand-alone dwellings (granny flats)

The granny flats building consent exemption allows certain new, single‑storey, standalone dwellings up to 70 square metres to be built without a building consent, provided all exemption conditions are met and the work is carried out or supervised by licensed building professionals.

All building work completed under this exemption must still comply with the New Zealand Building Code.

What the exemption allows

A small stand‑alone dwelling up to 70 square metres may be built without a building consent if:

  • The design is simple and meets the requirements of the New Zealand Building Code.
  • The homeowner notifies their local Council before construction begins and again once the work is completed.
  • All work is carried out or supervised by licensed building practitioners.
  • All exemption conditions are fully met.

The owner is responsible for determining whether the exemption applies.

Project Information Memorandum (PIM)

To qualify for this building consent exemption, you must apply for a Project Information Memorandum (PIM).

Project timeframe

Your project should be completed within two years.

If the work is expected to take longer, you need to contact the Council to apply for an extension.

What the Council will not do

Under this exemption, the Council will not:

  • Check whether your plans meet the Building Code
  • Carry out site inspections
  • Issue any certification once work is complete

The Council’s role is record‑keeping only.

What you must provide to the Council

Within 20 working days of completing the building work, you must submit:

  • Final plans
  • Records of Work (RoW) from licensed building practitioners
  • Plumbing, drainage, gasfitting, and electrical certificates

These documents will be added to the property file and will be included on any future LIM reports.
